Rules and regulations surrounding the use of marijuana are continually changing.  Recently there has been a shift in popular opinion as to the use of marijuana for medical purposes.  New York State has recognized this change and now allows the use of marijuana for certain medical conditions.

Contact us today if you have any questions about your right to use marijuana for medical purposes or if you have been arrested on a drug charge.

What is Medical Marijuana?

Marijuana has for decades been a prohibited drug regardless of its medical value.  However, popular sentiment to the drug has changed and there is a growing body of medical data that shows marijuana can have a positive impact on those suffering from terminal illnesses or injuries.

Marijuana can be used as part of a medical regiment designed to reduce or eliminate symptoms associated with various types of illnesses or other medical conditions.  For example, a cancer patient may wish to use medical marijuana to combat the side-effects of a toxic chemo therapy treatment.

There are specific limitations on the growing of marijuana for medical purposes in New York State.  Medical marijuana products must meet stringent rules and those permitted to grow marijuana for medical purposes are heavily regulated.

Is Medical Marijuana Permitted in New York State?

Medical marijuana is permitted and regulated in New York State.  In 2014, the New York State Legislature passed the Compassionate Care Act to create a regulatory structure for the safe use of marijuana for medical purposes.  Those seeking to use medical marijuana in New York State must first get approval from a certified medical professional.  The use of medical marijuana is closely regulated and there are limitations on the amount that can be purchased and possessed.

If you believe that the use of marijuana would help ease the symptoms associated with an illness or injury that you or a loved one suffers from, there are several things you will want to keep in mind.

  • Seek an Appropriate Diagnosis. Not all medical professionals can prescribe medical marijuana.  Make sure that you seek medical attention from a professional who can lawfully prescribe marijuana.
  • Limitations Still Apply. Receiving a prescription for the use of medical marijuana does not allow you to purchase or possess an unlimited amount of marijuana.  Take the time to understand what the limitations are and how to appropriately possess and use marijuana for medical purposes.
  • Use Authorized Vendors. Those who have been prescribed marijuana for medical purposes must purchase the marijuana only from authorized vendors.  A prescription for marijuana does not allow you to purchase marijuana from just anyone.

The regulations are extensive and complicated.  If you have any questions about your ability to obtain and use marijuana for medical purposes, one of our attorneys can discuss the entire process with you.  Furthermore, contact one of the drug possession lawyers at Epstein & Conroy, P.C. today if you have been arrested while lawfully using medical marijuana.
