Cybercrime

Cybercrime is increasingly becoming a top priority for both state and federal law enforcement.  Agencies at both levels are constantly developing new ways to uncover and investigate possible cybercrimes. As a result, cybercrime offenses are strongly prosecuted and can lead to serious consequences.

At Epstein & Conroy, we represent individuals and businesses in New York facing charges for computer tampering, computer trespass, unauthorized duplication, unauthorized use, criminal possession of computer related material, ransomware attacks, Bitcoin offenses and other cyber offenses.

Cybercrime Defined

The U.S. Department of Justice defines cybercrime as any illegal activity for which a computer is used as its primary means of commission, transmission, or storage.

There are many kinds of cybercrime, and the ways in which computers and networks can be used to commit crimes grows and changes almost daily. Some of the most common examples of cybercrimes include:

  • Identity theft
  • Computer viruses
  • Cyberbullying
  • Cyberstalking
  • Cyberterrorism
  • Internet sex crimes such as child pornography
  • Hacking

Cybercrime Offenses

Cybercrimes can be prosecuted under both New York state and federal law. There are many statutes that specifically address cybercrime, but more traditional charges such as larceny or harassment can also be brought for such crimes committed through the use of computers and networks.

Specific cybercrime offenses in New York include:

  • Unauthorized Use of a Computer, New York Penal Law Section 156.05
  • Computer Trespass, New York Penal Law Section 156.10
  • Computer Tampering, New York Penal Law Section 156.20-27
  • Cyberharassment, New York Penal Law Section 240.30

New York City Prosecutes Cybercrime Aggressively

Cybercrime involves constantly evolving levels of sophistication, but New York City police and prosecutors are some of the best equipped in the country to find and prosecute even the savviest cybercriminals.

In 2016, New York City opened a $10 million, first-of-its-kind cybercrime lab specifically to aid in the prosecution of computer-related offenses. Operated by the Manhattan District Attorney’s Office, the lab has over 75 full-time staff members, including assistant district attorneys assigned to the D.A.’s Cybercrime and Identity Theft Bureau and High Technology Analysis Unit. Additionally, NYPD investigators embedded within the Manhattan District Attorney’s Office, and multiple teams of cyber intelligence analysts, forensic analysts and cell site analysts are working 24/7 to hunt down cybercriminals.

With all of that law enforcement firepower at prosecutors’ disposal, you will be pursued and prosecuted to the full extent of the law if you are engaged in identity theft or other cybercrimes. Given the intensity with which prosecutors seek convictions for these offenses, it is essential that you retain experienced, knowledgeable, and aggressive defense counsel to fight any charges brought against you.
